Abstract

Due to the great development that the world is witnessing in various aspects of life، the criminal law reflects this development and follows it in parallel. It is noted that modern criminal law pays great attention to the issue of crime prevention in all its forms، whether in social، economic، cultural، political and other aspects. Among the phenomena that pose a serious challenge is habitual crime. At the present time، punitive and criminal efforts focus on preventing crime in all its forms، so we must search for methods and mechanisms to combat the phenomenon of habitual crime، and to enhance awareness of its dangers and negative effects on society. Through statutory law، the phenomenon of habituation to crime is dealt with in a multifaceted manner، as the focus is on holding individuals accountable for their criminal acts and applying appropriate penalties for those acts. The focus is also on crime prevention by enhancing collective awareness of the negative consequences of crime and providing social support and rehabilitation programs for criminals. On the other hand، Islamic jurisprudence is based on Islamic legal sources، including the Holy Qur’an، the Sunnah of the Prophet، the antiquities and sayings of scholars considered in Islamic jurisprudence. The phenomenon of habitual crime is considered a violation of Islamic teachings and Sharia laws، and we will discuss it in detail
