Abstract

The different nature of man is always known from his behavior towards society and this nature may take from the fruitful work mainly in its success, and some may take a vice axis to live in life, and since the life of sin is different and is divided in performance, so the pickpocket and embezzler, who are people who have taken from the wrong behavior a leading light for them in the daily life in the Islamic era. They are lazy people who cannot do anything save stealing other people's money secretly, it means that they employ their ideas and their jurisprudence I stealing only. The current research focuses on this idea by which mentioning their roles in history and follow their actions and their criminal methods besides historical and jurisprudential analysis during the history of the Arab Islamic stateThe punishment for both of them varies in Islamic law, and jurists have differed on it, because if the robber puts his hand in the sleeve of the person he wants to rob, his hand is cut off because he broke into the safe, but if he cuts the sleeve and drops the money on the ground and steals it, his hand is not cut off because he did not break into the safe, as for the embezzler, he is an apparent pickpocket who does not break into the safe, so his hand does not require cutting off, but his punishment is flogging and imprisonment, according to what came in the historical events that we mentioned in this research. The historical events that the Arab Islamic state went through are what determine the widespread or hidden spread of these people. In cases of insecurity during the Abbasid rule, these people are widely observed in the streets, markets and mosques, which explains the poor security conditions that the Arab Islamic state went through, especially after the intervention of the Turks and the emergence of the Seljuks and the separation of the regions from the center and internal wars. However, in cases of state strength and security, these people disappear except individually for fear of the authority in power at that time.
