The International criminal responsibility arising from the crime of environmental pollution with radioactive and chemical waste

Abstract

It was noticed the absence of the effectiveness of civil, administrative and international legal texts in deterring perpetrators of environmental pollution, which led to the growth and increase of environmental destruction, Despite the development that international laws have urged in the environmental aspect, they tend to pay more attention to the objective aspects of identifying crimes against the environment and criminal responsibility for them, at the expense of the procedural aspects of environmental protection in those laws. That is why the criminal law is one of the means that the international and national community resort to in combating environmental damage, such as corruption and pollution Therefore, the community saw the need to arrange responsibility and punishment for those who caused harm to the environment, and for this the regional and international community began to pay attention to this dangerous issue because of its impact on the environment and human health, and these international efforts culminated in the conclusion of several international and regional agreements, the most important of which was the Basel Convention in Switzerland for 1989, Concerning the Control of Transport of Hazardous Wastes. This Convention has made great efforts in its field of work and applications, In controlling, reducing or limiting the transfer or spread of such waste, and since the industrially developed countries tend to dispose of their waste by transporting them outside their territories to settle in one of the developing countries. The study dealt with two main topics, starting with the introduction, and ending with a conclusion in which a set of findings and recommendations are presented that may enhance criminal responsibility in the crime of environmental pollution by addressing in the first section the international criminal responsibility for the crime of environmental pollution and its radioactive activities, while in the second section we dealt with the CBRN team and its uses chemical and radiological weapons
