Abstract

This research reviews the role of the constitution in defining the economic system and regulating economic activities in different countries. The research focuses on how the constitution includes the foundations and guiding principles of the economic system, including the legal framework for trade and investment, intellectual property protection, wealth distribution, market regulation, and labor rights. The research also addresses the challenges and balances between economic freedom and social responsibility, and the role of judicial institutions in interpreting and applying the economic constitution. This research is considered an important introduction to understanding the impact of the constitution on economic policies and economic development in different countries. In addition, the research indicates the importance of understanding the impact of the Constitution on government economic policies and how applications of the Constitution can guide economic development. The research also reviews the challenges that countries may face in implementing the economic provisions of the Constitution, including the balance between the economic freedom of individuals and the public interest, and the necessity of achieving economic and social justice. The research also reviews the potential obstacles that may stand in the way of implementing the economic constitutional provisions, such as legal gaps or contradictions between National laws and the constitution. The research also discusses how to deal with these challenges to ensure the effectiveness of implementing the constitution in promoting sustainable economic growth and achieving social justice. The research concludes by providing recommendations on how to improve constitutional frameworks to ensure a better balance between economic freedom and the protection of public interests, focusing on the experiences of different countries and drawing on global best practices in this field. Recommendations include the need to enhance transparency and accountability in government institutions, develop an effective and independent judicial system to ensure the effective implementation of the Constitution, and enhance civil society participation in the formulation and implementation of economic policies. The research also indicates the importance of education and awareness of the vital role of the constitution in economic development to ensure broader and more effective participation of citizens in the economic process.
