Abstract

Crimes of public office have received the attention of the criminal legislator due to their great importance in affecting public interests, as they directly affect the interests of the state and society, and social damages are often serious, threatening the entity and interests of the state, both internal and external, and political stability, and affecting public confidence in its administrative and economic institutions. As a result of the widespread prevalence of crimes of public office, criminal legislation has sought to legislate laws that guarantee legal protection for public interests, by legislating appropriate penalties that are commensurate with each crime of public office crimes and ensuring the necessary protection of the public office, and following a punitive policy that is consistent with the seriousness of these crimes. Criminal penalties have varied with the variety of crimes, taking into account the legal and judicial circumstances in cases of aggravation and mitigation in penalties that affect the legislator's goal of providing adequate protection for the public office.

The matter that prompted us to choose this topic for our study is the types of criminal penalties in public office crimes in Iraq and Syria. It is clear from the title of the research that it talks about the types of criminal penalties in public office crimes, so we will explain these different types of criminal penalties that are imposed on the perpetrator of this crime. Public employees and those charged with public service.

The plan of this study consists of one topic under the title: Types of criminal penalties for public office crimes in Iraqi and Syrian criminal legislation. The study is divided into three requirements: the first, concepts and terminology. The second requirement: Types of criminal penalties for public office crimes in Iraqi criminal legislation, and the third requirement: Types of criminal penalties for public office crimes in Syrian criminal legislation, and finally we go back to the most important results and recommendations.
