Abstract

This research examines the powers and duties of the Qaimmaqam under Iraqi and Iranian law, as one of the important administrative positions within the framework of local administration and the implementation of administrative policies and decisions at the local level. The importance of this subject arises from the differences in the administrative and legal structures of Iraq and Iran, which result in differences in determining the scope of the powers granted to the Qaimmaqam and the nature of the duties assigned to this position.

The research aims to identify the legal framework governing the powers and duties of the Qaimmaqam under Iraqi and Iranian legislation, analyze the relevant legal provisions, and examine the similarities and differences between the two legal systems. It also addresses the administrative powers exercised by the Qaimmaqam and the duties associated with implementing laws, regulations, and administrative decisions, as well as the role of the Qaimmaqam in supervising local public services and coordinating among various administrative authorities.

The research adopts the descriptive, analytical, and comparative approach by examining and analyzing the relevant legal provisions in Iraqi and Iranian legislation and comparing them in order to identify the similarities and differences between the two systems. The research seeks to provide a clear legal understanding of the position, powers, and duties of the Qaimmaqam within the framework of local administration in both countries.
