Abstract

This research examines the criminal response to the crime of illicit enrichment under Iraqi legislation through an analytical and comparative study of Iranian legislation. It addresses the concept, legal nature, constituent elements, and penalties of the crime, while analyzing the specific features of its evidentiary framework, financial investigation procedures, asset tracing, and recovery. The study demonstrates that illicit enrichment constitutes an independent offense distinct from underlying financial crimes, and that the criterion of criminalization under Iraqi law is based on a disproportionate increase in wealth in relation to lawful resources, in contrast to the broader scope of Iranian regulation in addressing the acquisition of assets without legal entitlement or lawful basis. It also demonstrates that the reversal of the burden of proof is confined to establishing the legitimacy of the source of the increase in wealth, rather than extending to the other elements of the offense. The study concludes that legislative and procedural obstacles limit the effectiveness of asset tracing and recovery in Iraq, necessitating the development of mechanisms for asset preservation, financial tracing, and beneficial ownership identification, the enhancement of international judicial cooperation, and the strengthening of safeguards relating to the presumption of innocence.

This research adopted an analytical approach to studying the legal texts and provisions regulating the crime of illicit enrichment, and a comparative approach to comparing Iraqi and Iranian legislation. It also employed a critical methodology to identify legislative and procedural shortcomings and propose solutions.

The nature of the research necessitated its division into two sections: the first section addressed the substantive provisions of the crime of illicit enrichment, including its definition, the basis for its criminalization, its legal structure, and the prescribed penalties. The second section focused on procedural provisions and the establishment of proof, examining the specifics of investigation and evidence, investigative procedures, asset tracing, obstacles to implementation, and potential solutions and legislative reforms. The research concluded with a summary of the most important findings and recommendations.
