Given the recent proliferation of agricultural land fencing in the Kurdistan Region of Iraq, it became necessary to examine the issue from a legal perspective. The study aims to determine whether fencing is a right of the landowner, a state-mandated requirement in specific instances, or a phenomenon that has spread haphazardly without a specific legal framework. It also investigates how competent authorities handle agricultural fencing—ranging from initial procedures to maintenance, repair, and the removal of unauthorized fences—often in the absence of a clear legal vision. To comprehensively address the subject and formulate findings and recommendations for potential legislation, the study involved an in-depth analysis of agricultural laws and regulations, alongside field visits to the Kurdistan Region’s Ministry of Agriculture and various agricultural directorates to understand the prevailing procedures and mechanisms. The research employs a descriptive-analytical approach to examine relevant laws and official documents issued by agricultural authorities, complemented by a field-based approach involving direct visits to the concerned departments. This dual methodology bridges theoretical legal concepts with practical application and analyzes the procedural mechanisms implemented by the relevant official bodies. To highlight the key aspects of the research topic, we have divided the study into two sections. The first section examines the nature of agricultural land fencing—specifically, whether it constitutes a right held by the landowner or rights-holders, or an obligation imposed by the state. The second section is dedicated to the procedures for obtaining fencing approval, the prevailing practical standards, and how the relevant authorities handle unauthorized fencing.
