Transformative Constitutional Interpretation and Its Role in Developing Constitutional Meaning Beyond the Formal Amendment Mechanism

This study examines transformative constitutional interpretation and its role in developing constitutional meaning beyond the formal amendment mechanism. It begins by clarifying the conceptual foundations of transformative interpretation and distinguishing it from traditional constitutional interpretation. It then analyzes its principal judicial tools, including teleological and value-oriented interpretation, proportionality analysis, constitutional balancing, the expansion of rights and freedoms, and the derivation of unwritten constitutional principles. The study also refers to selected judicial examples from the United States, Germany, South Africa, and certain Arab constitutional experiences in order to show how judicial interpretation may contribute to the functional development of constitutional meaning without formal amendment. The study concludes that transformative interpretation may serve as a functional mechanism for addressing constitutional rigidity and strengthening rights protection. However, it may also lead to constitutional creation or judicial overreach unless it is constrained by clear safeguards, including fidelity to the constitutional text, coherence of the constitutional order, respect for constituent authority, methodological discipline in judicial reasoning, and guarantees of judicial independence and transparency. Accordingly, this research seeks to analyze and provide a theoretical foundation for the concept of transformative constitutional interpretation, outline its tools and practical mechanisms, and evaluate its role in evolving the constitutional text outside formal amendment procedures. It also attempts to establish a regulatory framework that balances the requirements of constitutional evolution with respect for the constituent will. The study employs a descriptive-analytical approach to define and theoretically ground the concept of transformative constitutional interpretation and to analyze its constitutional and judicial tools. It further draws upon selected foreign and Arab judicial precedents for scholarly reference and practical illustration, without making a comparative analysis of constitutional systems the primary subject of the research.
