The right to education is one of the most important foundations of human rights, as it has important and realistic results that cast their shadows on the economic and social growth and development of the state through individuals within societies. It is the actual gateway to scientific and practical life towards the future and prosperity of peoples. Education is the basic pillar upon which governments depend in their renaissance and development. The research reviewed the nature of the right to education, its most prominent features, and knowledge of its legal framework at the international and local levels, in order to then know how to organize it constitutionally according to the Iraqi Constitution in force 2005 and to shed light on the strengths and weaknesses of the constitutional provisions, arriving at a number of conclusions and recommendations that the research came up with.
The research contained three sections. In the first section, we addressed the nature of the right to education by defining it and identifying its most prominent features. We then moved to the second section, in which we explained the legal framework for the right to education at the international and local levels. As for the third section, we learned about the constitutional organization of the right to education according to the current Iraqi constitution of 2005 and the practical reality. We concluded the research with a number of conclusions and recommendations.
