Forced displacement constitutes one of the most serious violations of fundamental human rights, thereby necessitating a comprehensive examination of the legal frameworks governing its prohibition and prevention. This study critically analyzes the relevant provisions of International Humanitarian Law and International Human Rights Law, evaluates the effectiveness of existing human rights protection mechanisms, and identifies the conceptual and practical challenges associated with the implementation of these legal norms. The research further examines the adequacy of current international legal frameworks in preventing and remedying acts of forced displacement, emphasizing that the existence of a firm legal prohibition, reinforced by effective accountability and human rights mechanisms, represents an essential safeguard against such violations.
Moreover, the study explores both historical and contemporary instances of forced displacement, thereby contributing to the evolving scholarly and legal discourse within the international legal order. The findings of the study demonstrate that forced displacement is unequivocally prohibited under various international legal instruments and is fundamentally incompatible with the core principles of justice, humanity, and the protection of human dignity. The study also addresses the position of the Iraqi Constitution concerning the prohibition of forced displacement. Finally, the proposed recommendations urge states and regional organizations to adopt more effective measures aimed at preventing forced displacement through strengthening legal frameworks, enhancing accountability mechanisms, and ensuring effective protection for affected populations. This research focuses on cases of forced transfer within the broader context of international humanitarian law and international human rights law. The study includes historical and contemporary examples, providing a comprehensive understanding of the evolution of the prohibition against forced transfer and its current manifestations.
The research methodology employs a multifaceted approach, incorporating in-depth legal analysis of international law and international human rights law. This combination of research ensures a thorough examination of the subject and offers a nuanced perspective on the prohibition of forced transfer within the international legal landscape.
