The government's authority over the issue in the current Iraqi constitution

Abstract

The study aimed to shed light on the manifestations of government authority over regions in the current Iraqi constitution, and to demonstrate the extent to which executive authorities are committed to implementing constitutional provisions relating to the formation of regions according to the federal system. The study focused on analyzing the legal and political aspects that led to the disruption of this constitutional right, and reviewed previous experiences of attempts to form regions, and the obstacles that these initiatives faced. The researcher believes that there is an actual and repeated obstruction of the constitutional texts related to the regions by the executive authority, and that this obstruction reflects the lack of seriousness in implementing the federal system, in addition to the existence of conflicting political interpretations of the constitutional texts, and the absence of a legislative and administrative structure supporting their implementation, which requires the activation of the constitutional texts related to the formation of the regions. Establish binding legal mechanisms to ensure their implementation, while adopting the principle of balance between the center and the regions to ensure the unity of the state within a fair federal framework.
