Abstract

This research examines the system of refraining from pronouncing punishment as one of the mechanisms that enables the criminal judge to take into consideration the particular circumstances of the offence and the offender when determining whether the imposition of the principal punishment is appropriate. The study aims to identify the legal conditions governing the court's exercise of this discretionary power, distinguishing between conditions related to the offence and those related to the offender's personality, while also examining the legal consequences arising from a judgment of refraining from pronouncing punishment. The study demonstrates that this system does not negate criminal liability or deny the establishment of the offence; rather, it involves refraining from pronouncing the principal punishment within the limits permitted by law, while subjecting the convicted person to certain conditions and obligations during the period determined by the court. The research also examines the consequences of complying with these conditions and the expiry of the prescribed period, as well as the extent to which refraining from pronouncing punishment affects ancillary and supplementary penalties. The study concludes that the effectiveness of this system depends on the clarity of its legal safeguards and the proper exercise of judicial discretion, in a manner that balances the requirements of deterrence and social protection with considerations of rehabilitation and the individualized application of criminal sanctions.

The importance of studying this system is further highlighted by the legal consequences arising from its imposition; its effect is not limited to the mere withholding of the pronouncement of a penalty but entails obligations and conditions that the convicted person must observe during the period specified by the court. Compliance with these conditions and the expiration of the prescribed period result in specific legal consequences, whereas non-compliance leads to outcomes determined by statutory provisions. Furthermore, the system raises questions regarding the extent to which the withholding of the pronouncement of a penalty affects principal, accessory, and supplementary penalties, thereby necessitating a precise determination of the legal consequences of such a ruling.
