Abstract

This study examines the phenomenon of low-quality content across digital platforms by establishing its conceptual and social framework and highlighting the ambiguity and lack of clarity surrounding its legal definition within Iraqi legislation. The study categorizes such content in accordance with the provisions of Iraqi Penal Code No. 111 of 1969 which is founded, among other considerations, on the protection of public morality and privacy, while addressing the criminal and civil liability arising from its production and dissemination. The research further emphasizes the pivotal role of academic institutions in promoting digital literacy and critical thinking as means of mitigating the adverse effects associated with such content. The study concludes with a set of findings and recommendations calling upon legislative and executive authorities to strengthen legal and procedural mechanisms and to establish a regulatory framework that maintains a constitutional balance between safeguarding the intellectual security of society and protecting freedom of expression.

The importance of this research lies in the seriousness of the phenomenon of inappropriate content and its negative impact on moral, social, and cultural values, particularly among youth and social media users. Its significance also lies in defining the legal framework governing this phenomenon and proposing legislative and academic approaches to curb its spread, while striking a balance between protecting society and guaranteeing freedom of expression.

This study adopted a descriptive-analytical approach, defining the concept of inappropriate content, its characteristics, forms, and various effects, and analyzing relevant national and international legal texts. It also employed a comparative legal approach in some sections, comparing Iraqi legislation with other Arab and foreign laws, in addition to examining judicial and jurisprudential trends related to legal liability arising from the production and dissemination of inappropriate content.
