Criminal Policy for Crimes Affecting Diversity and Social Peace in Iraqi Law

Abstract

         The criminal policy for crimes involving diversity and social peace in Iraqi law is one of the sensitive and dangerous topics that arouses the attention of all modern legal systems, because the actions and behaviors that threaten the social fabric and peaceful coexistence are crimes that directly affect the security and stability of society and the state, and dealing with these actions and behaviors requires an active and comprehensive legal framework, so the criminal policy in dealing with these crimes that are dangerous to society and the state is one of the tools It is crucial to guarantee the realization of justice and the protection of the general system, as well as the guarantee that punishments for the perpetrators of these crimes will be deterred, and at the same time human rights will be protected, and they will not be violated. To address this problem, we adopted a scientific and descriptive approach by highlighting and defining the subject matter. This was complemented by an analytical approach, appropriate to the nature of the study, particularly the analysis of legal texts and scholarly opinions, and the evaluation of the application of criminalization and punishment policies.

In three sections, we examined the criminal policy for crimes affecting diversity and social peace in Iraq. The first section addressed the concept of criminal policy and its characteristics. The second section focused on criminalization and punishment policies for protecting diversity and social peace. The third section examined the preventive and procedural aspects of policies for protecting diversity and social peace.
