Protecting Biodiversity from the Perspective of International Environmental Law

Despite the passage of three decades of international environmental efforts and their promotion of worthy global goals, however, the indicators of biodiversity loss have not improved, but have worsened accordingly. the research aims to answer a key question to what extent the rules of international law aimed at protecting Biological Diversity are characterized by fundamental flaws at the level of theoretical construction or that the gap lies in the mechanisms of implementation and national control. therefore, this study comes to shed light on the international legal structure for the protection of Biological Diversity, and discuss the effectiveness of customary rules and the convention in addressing the risks posed to species and systems Through a critical analysis of the legislative frameworks and international jurisprudence in this vital field. The research concludes that the traditional protection of biodiversity has become insufficient, and suggests the need to recognize that the attack on the environment and the threat to its biodiversity constitutes an" environmental crime" part of International Criminal Law, and emphasize that the sustainability of biodiversity is a prerequisite for achieving the Sustainable Development Goals for 2030, and in the sense of violation that any violation of this commitment will affect the food and health security of the international community. The research is structured to cover philosophical and conventional aspects, as well as practical and critical ones. Therefore, the study will be divided into two sections: (Section One) the conceptual framework of biodiversity under international protection, and (Section Two) the international mechanisms related to the protection of biodiversity.
