Abstract

Bribery undermines trust in state institutions, destroys societal morals, corrupts justice, and diverts tax funds from their proper destination. In addition to legal consequences such as fines and imprisonment for those involved, bribery is also considered a crime that violates the duties of the job, a breach of trust, and violates the principles of justice and equal opportunity It is forbidden to ask for, accept, or give a bribe, just as it is forbidden to act as an intermediary between the briber and the bribed. As for the bribe by which a person obtains his right or to ward off injustice or harm, it is permissible according to the majority, and the sin is on the briber, not the one who gives the bribe. We must refer to the provisions of Islamic Sharia and the Islamic jurisprudence in dealing with the phenomenon of bribery and imposing punishment in a way that achieves the goal and serves the purpose of reform and discipline by making the punishment appropriate to the crime.
