Legal Means to Compel the Administration to Execute Administrative Judicial Rulings

This study examines the legal mechanisms employed by judicial authorities to compel administrative bodies to enforce administrative judicial rulings issued against them, with a particular focus on the challenges encountered in the enforcement process and the strategies to overcome these obstacles. The study begins by emphasizing that the enforcement of administrative judicial rulings is a fundamental pillar for ensuring justice and protecting individual rights. It underscores that judicial rulings represent the embodiment of legal truth and a primary means to achieve justice; however, the practical reality reveals numerous challenges that impede the full and effective enforcement of these rulings.
Among these challenges is the absence of a dedicated and specific legislative framework for the enforcement of administrative rulings. Administrative claims are often processed according to civil procedural rules, which lack clear or specific methods to guarantee the enforcement of rulings against administrative entities, thus creating opportunities for delays or outright refusal to comply. The study also identifies technical and procedural obstacles stemming from ambiguous legal texts and varied interpretations, coupled with overlapping jurisdictions among different judicial bodies, which collectively foster conditions of laxity or procrastination.
Moreover, the enforcement system suffers from procedural disorganization and a lack of deterrent tools, such as the imposition of threat fines or direct enforcement orders, as enforcement often depends on the discretion of executing entities, thereby exposing the process to further violations and delays. Additionally, the absence of specialized judicial institutions exclusively tasked with enforcing administrative rulings, alongside the lack of clear legal mechanisms compelling administrations to comply, highlights the urgent need to develop national legislation and activate the role of administrative courts to impose execution through direct orders and sanctions on non-compliant parties.
The study concludes that activating legal mechanisms by updating legislation, providing clear enforcement procedures, and empowering the administrative judiciary represents the true pathway to achieving a qualitative shift in the enforcement of judicial decisions. This approach ensures the respect of the rule of law and safeguards individual rights against administrative authorities, especially amid increasing legal and administrative challenges that obstruct enforcement and negatively affect social and communal justice.
