Abstract

The modern technology, Internet advancement and the progress of individuals in terms of work and economic activity cannot happen without finding appropriate ways to pay, In the current economic turmoil in Iraq and the Kurdistan Region, payment systems can be based on advanced technology, which will directly change banking activities, The use of electronic services plays an important role in the economy and is unprecedented in terms of speed and shortening of routes.

The term bitcoin is used to describe the concept of electronic money or digital currency or electronic cash. In this paper, based on the method of comparative analysis of the legal and jurisprudence dimensions of bitcoin and the recognition of bitcoin currency, which is a new type of money and its characteristics and the position of Iraq and the Kurdistan Region in terms of laws and fatwas of the Supreme Council of Religious Scholars regarding the transaction and trading use of bitcoin The researcher has come to the conclusion that there is a legal gap for regulation and how to deal with bitcoin. Regarding the method of our research, they use comparative analysis methods by discussing and analyzing the subject, putting the opinions of the authors and researchers and comparing bitcoin between Islamic law and Sharia. My research includes a new and contemporary topic that discusses the legal and jurisprudence of Bitcoin in five parts
