Abstract

This research examines the legal status of refugees under international law, outlining the legal basis governing their status according to the 1951 Geneva Convention and its 1967 Protocol. It clarifies the most important rights enjoyed by refugees, such as protection from refoulement, access to education, employment, and healthcare, as well as their obligations towards the host country. The research presents the most prominent legal and practical challenges hindering the effective implementation of these rules, including variations in national legislation and weak mechanisms for enforcing international agreements. The research concludes that a gap exists between legal texts and practical reality, necessitating enhanced international cooperation and the development of legislation to ensure more effective protection for refugees. This research employs an analytical-descriptive approach, analyzing international legal texts and conventions related to refugees. It utilizes a comparative approach to present regional models of how states deal with refugees, and draws upon case studies and relevant international reports.

 

This research comprises three sections. The first section, "The Theoretical and Legal Framework of the Refugee Concept," includes two subsections: the first defines a refugee in international law, and the second examines the sources of a refugee's legal status. The second section, "The Rights and Obligations of Refugees in International Law," comprises two subsections: the first addresses refugee rights, and the second outlines refugees' obligations towards the host state. The third section, "Legal and Practical Challenges Facing Refugees," includes two subsections: the first explores the challenges of implementing international conventions, and the second examines the gap between legal protection and actual practices. The research also includes an introduction and a conclusion.
