Abstract

This study aimed to clarify the impact of artificial intelligence applications on administrative decision-making, through identifying the concepts of artificial intelligence and its characteristics, and highlighting the differences between traditional management and management that uses artificial intelligence. The research relied on the descriptive analytical method, where the nature of programmed and programmed decisions, as well as the conditions for the validity of electronic administrative decisions, were analyzed. The study concluded that artificial intelligence contributes to the speed and accuracy of decision-making, but it raises legal issues related to transparency and judicial oversight, especially in the absence of advanced legal texts to keep up with these technologies. The research recommended the necessity of establishing clear legal frameworks to govern the use of artificial intelligence in administration, along with the need to involve citizens in monitoring the impact of these decisions.

The use of artificial intelligence (AI) in the issuance of administrative decisions presents a legal challenge concerning the principle of legality and the right to seek judicial redress. This stems from a lack of transparency in how AI systems operate, which complicates the ability to challenge such decisions in court—thereby undermining the principle of equality in legal status. Current administrative legislation, particularly in most Arab countries, lacks explicit provisions regulating the role of AI in administrative decision-making. This creates a legal vacuum that threatens the acquired rights of individuals and weakens judicial oversight of administrative actions. Drawing upon the general principles of administrative law, the researcher has identified the essential requirements for the validity of an administrative decision.
