Rights and Obligations of Parties to a Film Production Contract: A Comparative Study in Iraqi, Iranian, and European Law

This research presents a comparative analytical study of the rights and obligations of the two parties to the film production contract, namely the author and the producer, in light of Iraqi and Iranian legislations and European legal principles. The research aims to highlight the legal nature of this complex contract, which combines creative rights (moral and artistic) with financial and commercial obligations.
The first section of the research addresses the moral and material rights of the author, while the second section focuses on the mutual obligations between the two contracting parties, ranging from the creation and delivery of the artistic work to the provision of financial funding and respect for moral rights. The third section examines regulatory and supervisory procedures, such as obtaining official licenses and contract registration, as well as the obligation of publication and commercial exploitation. The research concludes by presenting a set of findings and recommendations aimed at addressing legislative gaps and enhancing contractual balance to ensure the protection of creators' rights and the stability of the cinematic production process.
