Abstract

In order to restore the right to justice lies in the implementation of judicial decisions, as this can only be achieved on the ground by implementing the decision without obstacles, as implementation is the mechanism for the decision to gain its practical value. However, there are difficulties facing implementation against the administration, as the administration’s refusal to implement is still a tangible phenomenon in many countries due to the administration’s failure to understand the importance of implementing judicial decisions. For a long time, the administrative judiciary lacked a mechanism that obligates the administration to comply with its rulings in the event that it refrains from implementing the judicial decision, which constituted a weakness in the face of the administration. The absence of ways to guarantee the implementation of the ruling or judicial decision leads to a weakening of the judicial guarantee to protect the rights of the individual from any abuse. A serious matter that affects his rights or legal status.In this topic, we tried to shed light on the mechanism of forcing or forcing the administration to implement the ruling or judicial decision through threatening fines and seizure of the administration’s funds that are not allocated for public benefit.
