Abstract

The research deals with the crime of abortion as one of the issues that affect morality, law and society. It reviews the definition of abortion, its types and causes, with a statement of the legal bases that criminalize it and the penalties resulting from it in Iraqi legislation. The research also highlights the role of the parties involved in abortion, such as the pregnant woman, doctors and pharmacists, and explains the legal responsibility of each of them. The research also focuses on the criminal aspects of the crime of abortion, including the violation of the rights of the fetus and the threat to public order and morality, with the aim of raising awareness among individuals of the legal and social consequences of this crime, while highlighting the importance of the law in deterring such behaviors, and the necessity of spreading legal awareness to reduce cases of illegal abortion. The research problem lies in its treatment of a complex topic with multiple interpretations. The legal consequences of abortion resulting from adultery differ from those of abortions performed for medical reasons, and also differ from those of abortions performed under duress. Therefore, the central question of this research is how criminal laws addressing abortion are adapted to all types of abortion.

This research employs an analytical and descriptive approach in defining abortion, outlining its types and causes, and examining the relevant legal texts.This research is structured around two main sections. The first section defines abortion and presents the legal and religious perspectives on it. The second section addresses the legal consequences of abortion.
