The Role of the Federal Court in Resolving Disputes Arising from the Application of Federal Laws

Abstract

      This research examines the role played by the Federal Supreme Court in the federal state, as the highest judicial authority responsible for adjudicating disputes related to the application and interpretation of federal laws and resolving disputes that arise between them. It highlights the constitutional importance of the court in achieving a balance between federal authorities and the authorities of the regions or governorates, especially in light of the multiplicity of powers and legislation. The research also reviews the legal framework regulating the work of the court, the challenges it faces in performing its duties, and evaluates the effectiveness of its decisions in preserving the legal unity of the state. The research concludes with the importance of strengthening the role and independence of the court to ensure the stability of the federal system and consolidate the principles of justice and the rule of law. We will address this topic in two sections. The first is devoted to the nature of the Federal Supreme Court, and the first section is devoted to the establishment of the Federal Supreme Court in Iraq. The second section is devoted to the independence of the court and the legal status of its members. The second section discusses the role of the Federal Supreme Court in adjudicating disputes arising from the application of federal laws and the validity of these decisions arising from disputes, drawing from them a set of conclusions and recommendations.
