Abstract

This research examines the procedures for vehicle searches under Iraqi and Kuwaiti law. As an investigative measure that impinges upon the sanctity and privacy of individuals—as well as the personal vehicles, items, and documents in their possession—the legislature has subjected this procedure to a set of legal rules and provisions. These aim to strike a balance between uncovering and proving the commission of a crime, on the one hand, and protecting individual sanctity and privacy, on the other. The study begins by outlining the legal foundations of search procedures and the extent to which they are governed by the general rules, conditions, and provisions regulating searches in both Iraqi and Kuwaiti law, while also comparing the mandatory conditions required for the validity of such search procedures

Our research is limited to examining the legal procedures and conditions governing vehicle searches, without delving into the substantive consequences of the search itself or the evidence obtained—except where directly relevant to our topic. We have divided the study into two sections: the first addresses the formal requirements for vehicle searches, comprising three subsections—the necessity of substantiating the search order, the requirement for a search order to exist, and the method of executing the search. The second section addresses the substantive conditions for search procedures, also divided into two subsections: the existence of a criminal act and the existence of an accusation against the person whose vehicle is to be searched. We also highlight the legal link between the lawful conditions for a search and the safeguards ensuring the procedure does not devolve into an investigation lacking any legal basis

The research concludes that the lawfulness of vehicle searches under Iraqi and Kuwaiti law does not rest solely on the authority of those conducting the search; rather, it requires adherence to a set of procedural and substantive rules, provisions, and safeguards governing the search's legality, limits, scope, and execution. Furthermore, for the search procedures to be valid, a crime must have occurred or an accusation must have been leveled against an individual, and the search must be conducted by competent authorities legally empowered to ensure procedural safeguards, protect individual rights, and prevent any violation of the statutory provisions regulating search procedures
