Abstract

The mechanism of enforcing a penalty represents a crucial stage in criminal policy, as it is the phase through which the objectives of criminal sanctions are realized—objectives that penal institutions seek to translate into practical effect. The substance of enforcement has not been uniform since human societies first recognized criminal punishment as a reaction to threats against their existence and the interests of their members. Moreover, the purpose behind imposing a criminal sanction has varied, evolving in accordance with the development, modernity, and severity of criminal behavior

The effect of a criminal sanction is inherently dependent upon its execution, which is characterized by its compulsory nature without any intervention of the convicted person’s will. A judgment imposing a penalty—including subsidiary penalties—is not directed at the convicted individual for voluntary compliance, but rather at the competent authority of the State entrusted with the exclusive power to enforce the sanction due to the offender’s breach of society’s rights

This stage constitutes the phase in which the true aim of punishment is fulfilled. Therefore, the enforcement authority must act to achieve this aim. Enforcement is not merely the deprivation of one of the convict’s rights or the infliction of suffering in accordance with contemporary criminal policy; rather, it carries a deeper purpose reflected in rehabilitating and re-educating the offender and preparing them for social reintegration, away from the risk of relapse into crime—particularly crimes related to internal and external state security, forgery, bribery, embezzlement, theft, and homicide

This underscores the significance of the enforcement stage in both principal and ancillary penalties. It represents the activity undertaken by the State with the aim of giving practical effect to the content of a judicial ruling in real life and bringing it into tangible existence
