Abstract

The judiciary is a set of principles and guidelines that govern the work of the judiciary in all countries of the world. This leads to the independence of the judiciary from the executive and legislative authorities، and also ensures the implementation of the law. This leads to the ability to guide society and understand the decisions binding on its members                                                                                 

It is also characterised by generality and monopoly over legitimate means of coercion، in addition to possessing legitimacy، bearing responsibility، enforcing the law and punishing those who violate it، all within the framework of the law that it supports. The judicial authority is considered the third branch of government and is separate from the two authorities، and it has the right to monitor the two branches، the executive and legislative authorities .                                                                 

Allah the Almighty says: (And We have revealed to you، [O Muhammad]، the Book in truth، confirming that which preceded it of the Scripture and as a criterion over it. So judge between them by what Allah has revealed and do not follow their inclinations away from what has come to you of the truth. To each of you We prescribed a law and a method. And if Allah had willed، He would have made you one community، but [He did not] choose                                                                                    

So that He may test you in what He has given you، so race to [do] good deeds. To Allah is your return، all of you، and He will inform you about that over which you used to differ. (48) (Al-Ma'idah) The research includes three sections.

The first section: The concept of judicial policy، which includes two requirements.
