Applications of the impact of verses from the Holy Quran on the constitution: A comparative study of Iraq and Egypt

Abstract

         Both the Iraqi and Egyptian constitutions are constitutional models that have been influenced to varying degrees by Islamic reference, as they include texts that reflect, directly or indirectly, the influence of the Holy Qur’an in building constitutional rules and provisions. This research aims to identify the constitutional texts that are inspired by the Holy Qur’an in the Iraqi constitution, as well as to identify the constitutional texts that are inspired by the Holy Qur’an in the Egyptian constitution. The descriptive, analytical, and comparative method was used, and this research was divided into two sections, The first was entitled “Constitutional Texts Inspired by the Holy Qur’an in the Iraqi Constitution,” while the second was entitled “Constitutional Texts Inspired by the Holy Qur’an in the Egyptian Constitution.” In conclusion, it was found that the Iraqi and Egyptian constitutions recognize Islam as a primary source of legislation, which reflects the direct influence of the verses of the Holy Qur’an in building the constitutional system and organizing legal rules. The researcher recommends the necessity of strengthening the inclusion of Qur’anic principles related to justice and equity in national legislation in a manner consistent with the constitutional texts in Iraq and Egypt.
