Challenges and Solutions for Human Rights and Intellectual and Artistic Property Rights

Abstract

Human rights are among the fundamental issues that have preoccupied human thought for centuries. Their concepts and principles have evolved over time as a result of the social, political, and cultural transformations witnessed in the world. They represent the fundamental foundation upon which human society is built and constitute the true guarantee of respect for human dignity and fundamental freedoms. In an increasingly interconnected and complex world, it has become imperative to promote a culture of rights and establish it as a constant principle in all aspects of life. Today, human rights have become an integral part of legal and political discourse, both domestically and internationally, and no legal system can ignore them or diminish their importance. They encompass a wide spectrum of rights, including the right to life, liberty, security, education, health, freedom of expression, political participation, and other rights that are essential for building a just and balanced society. From this perspective, it has also become important to view literary and artistic property rights as an integral part of the human rights system, given their role in preserving creativity and protecting the intellectual and cultural output of individuals and societies. Literary and artistic property rights are not limited to material aspects, but extend to include moral aspects that reflect human identity and intellectual expression. These rights are closely linked to freedom of expression and creativity, and constitute a means of promoting cultural diversity and preserving human heritage. In light of the technological boom and the proliferation of modern communication methods, the need to regulate these rights and protect them from violations that may take various forms, including plagiarism, digital piracy, forgery, copyright infringement, and other practices that harm creators and diminish the value of their works has increased. In this context, both human rights and intellectual property rights face many complex challenges that intersect with legal, economic, cultural, and technical dimensions. Some societies still suffer from the absence of adequate legal frameworks or weak implementation, while others suffer from a lack of awareness and interest in these rights. Furthermore, the digital revolution has brought about a major transformation in the way information is circulated and disseminated, leading to an expansion of the scope of infringement on the rights of authors and artists. Modern technology has become a dual tool, capable of serving as both a tool for protection and a tool for violation. In light of these challenges, it has become imperative to seek effective and sustainable solutions based on a combination of awareness-raising, legislation, and technology to ensure a balance between protecting rights and promoting freedom of expression and creativity. From this standpoint, the need arises to adopt comprehensive strategies that take into account the specificities of each society and work to build a legal and institutional system capable of ensuring the effective protection of these rights. This study aims to shed light on the issues related to the protection of human rights and literary and artistic property rights, and to analyze the reasons that lead to weak respect for these rights in some environments, whether legal, institutional, or cultural. It also seeks to present an analytical approach that combines theoretical and analytical aspects, with the aim of offering practical solutions that can contribute to strengthening the culture of rights, supporting creators, and ensuring the protection of their intellectual and artistic production. It must be noted that the relationship between human rights and intellectual property rights is not always harmonious. Rather, it may sometimes experience tension or contradiction, especially when individual interests conflict with public interests, or when intellectual property protection is exploited as a means to control knowledge and restrict access to it. This calls for a balanced and rational approach that takes into account the human dimension of rights, without neglecting the creative and economic aspects represented by intellectual property. In light of the above, it can be said that studying this issue is gaining increasing importance in today's world, not only because it relates to individual rights and freedoms, but also because it touches on the core relationship between humanity, creativity, and knowledge. It poses fundamental questions regarding how to build a legal and humane system capable of protecting rights without compromising freedom of expression or impeding scientific and cultural progress. The objective of this study is not limited to analyzing reality or presenting challenges, but rather extends to exploring practical mechanisms through which rights protection can be enhanced and legislative and institutional tools developed to ensure their effectiveness and sustainability. It also seeks to stimulate scholarly debate on the best ways to achieve harmony between the requirements of protecting creativity and ensuring the right to access knowledge, within a framework that respects human dignity and promotes democratic values. Accordingly, the study will address three main themes in its upcoming chapters. The first addresses the theoretical and conceptual framework of human rights and literary and artistic property rights. The second addresses the most prominent challenges facing these rights in contemporary reality, at the legal, digital, and cultural levels. The third focuses on reviewing the most prominent solutions and practical proposals that would enhance protection and promote legal awareness in modern societies.
